Objet : Demande d’information sur la situation juridique des partis politiques ayant fusionné avec les partis ( PASTEF – Kiiraay ) et actualisation du fichier national des partis politiques
Monsieur le Ministre,
Je viens respectueusement porter à votre attention la présente correspondance relative à une question qui intéresse au plus haut point la consolidation de notre démocratie, la sécurité juridique des formations politiques ainsi que la sincérité du pluralisme consacré par la Constitution de la République du Sénégal.
Lors des concertations engagées avec les formations politiques sous l’autorité de votre prédécesseur, il avait été rappelé que le Sénégal comptait 399 partis politiques légalement reconnus, une situation qui appelait une réflexion approfondie sur la rationalisation du paysage politique national.
Un nombre significatif de partis politiques a publiquement annoncé sa fusion avec les partis ( PASTEF et Kiiraay ). Cette évolution majeure soulève, au regard du droit positif sénégalais, plusieurs interrogations légitimes.
En effet, conformément aux principes gouvernant les partis politiques ainsi qu’aux règles régissant leur disparition juridique, une fusion emporte normalement extinction de la personnalité juridique de la formation absorbée, sous réserve de l’accomplissement des formalités prévues par les textes en vigueur.
Dès lors, un parti ayant régulièrement cessé d’exister ne saurait, sauf création nouvelle dans les conditions légales, prétendre reprendre ultérieurement une existence juridique autonome.
Dans ce contexte, je sollicite respectueusement de votre haute autorité :
– La communication du nombre actualisé des partis politiques légalement enregistrés au Sénégal ;
– La liste officielle des formations politiques encore juridiquement existantes ;
– La liste des partis ayant fait l’objet d’une fusion régulièrement constatée avec les partis ( PASTEF et Kiiraay ) ;
– Ainsi que les mesures administratives prises par vos services afin de constater, le cas échéant, l’extinction juridique des partis concernés et leur radiation du fichier national des partis politiques.
Cette clarification apparaît indispensable afin de préserver la sécurité juridique, d’éviter toute confusion dans le fonctionnement de notre système partisan et de prévenir toute tentative éventuelle de réactivation de formations politiques dont l’existence aurait juridiquement pris fin du fait de leur fusion.
Ayant eu l’honneur de servir, il y’a quelques années, sous l’autorité de la plus Haute Institution de l’État, j’ai pu apprécier votre attachement constant au respect de la légalité, votre rigueur dans l’application des textes ainsi que votre sens élevé de l’État.
